Law is involved in fatal accidents Act 1976, and Law Reform (Miscellaneous Provisions) Act 1934.
1. Expenses incurred Deathbed
LRMPA allows coverage of funeral expenses under Section 1 (2) (c) which provides for the deceased's estate for wanted them.
In addition, other expenses may also be required to LRMPA. These are limited to that of dead people could have claimed that he had lived. Article 1 (1) states LRMPA:
Subject to the provisions of this section to death of any person after the commencement of this law all causes of action subsisting against or giving it to survive against, or, as the case may be, for the benefit of, his estate.
2. Definition of "Funeral expenses"
"Funeral expenses" are not defined in the Act either. Neither case law to give us a definition of many. What is The case law is clear that the requirements under the law to LRMPA two fatal accidents in 1976 and 1934, funeral expenses should be ' reasonable 'under all circumstances. Test seems to be the same in both Acts. Relevant circumstances will include the dead station in life, occupation and racial origin (Goldstein v Salvation Army Insurance Society [1917] 2 KB 291; v Griffiths Hart-Jones [1948] 2 All ER 729 at 731 for Streatfield J, Gammell v Wilson [1982] AC 27, [1980] 2 All ER 557, CA).
Some examples of what has been considered to be (a) funeral expenses and (b) reasonable costs or unreasonable funeral through case law include:
Reasonable
St George v Turner [2003] CLY 936 - a special case in which damages were recovered for funeral expenses in Japan exceed 50,000 pounds, including an altar Buddhist household equipment, funeral expenses, expenses of a renaming ceremony for the dead Buddhist, payments for attendance by Buddhist monks, a tombstone and works, a memorial day of waiting, and waiting on a birthday. A Japanese woman was killed by her husband in English. McGregor in Damages in this case comments "It is thought that this is much more to be delivered extreme, murder may not affect the level of recovery for funeral expenses "
v marquise Smith / Bowbelle (January 27, 1993) - A reception was allowed to fit. 'An applicant can not ignore the social obligation to provide a few drinks' guests. social etiquette must be observed and spent £ 400 were found. See also St George v Turner (May 10, 2003, unreported). Contrast Gammell v Wilson [1982] AC 27, CA
Gammell v Wilson (First degree) - A headstone or tombstone shall be deemed a reasonable expense. Also, reasonable funeral expenses may include costs burial in another country if that is where the dead come (see also Turner v St George above)
Eisovitch v Schneider [1960] 2QB 430 - the cost of two family members who went to France to arrange for the return of) the body (brother were reasonable. Paull J decided that the services provided should be required and how costs will be occurred in any case, they were reasonable.
Hart v Jones Griffiths [1948] 2 All ER 729 - Embalming body a child four years was a reasonable expense.
Goldstein v Salvation Army Assurance Society [1917] 2291 KB - The cost of a tombstone was reasonable.
Unreasonable
Harding v Scott-Moncrieff [2004] EWHC 1733 (QB) - burial expenses do not include the cost of a memorial service, "attorneys fees," fees of accountants and a report of the assessor.
Brent v Quainoo and hassle Area Health Authority (1982) 132 NLJ 1100 AND Gammell v Wilson [1982] AC 27, CA - spending a wake over-processed failed.
Gammell v Wilson [1982] AC 27, CA - Court of Appeals held, with some hesitation, the trial judge the price of £ 595 for a headstone about a funeral that took place in 1976. A member The court noted that "tombstone ... in this case was very close to the border between a headstone and a memorial. Court of Appeal approved the approach 'that there is a difference between a headstone finished off, describing and marking the grave, which is part of the cost of burial and a memorial, which is not '. The costs for processing and Eve were mourning clothes be irreversible.
Stanton v F Youldon Ewart Ltd [1960] 1 All ER 429, [1960] 1 WLR 543 - expense in a memorial or monument was not reasonable under the circumstances, but a simple headstone will be allowed. McNair J said "Position law is that a stone on the grave as can be seen as part of funeral expenses if a reasonable costs for persons position of the deceased and relatives who are actually responsible for ordering the stone, but as it is simply a reminder to set up as a sign of love and affection, then it should not be included. a "
Claim also included five pounds paid to the Minister to attend the funeral, £ 8 for two additional cars in the funeral limousine, of five pounds to remove the body of the house. These payments are included as well as reasonable funeral expenses in damages recovered.
Sadly, there is no definitive definition of the cost of burial, or, more importantly, reasonable funeral expenses. When considering these items in a fatal accident claim, it would be a case of considering the case of both the law and acts for guidance, and making a trial reasonable based on this.
